利用規約（使用許諾契約）
本規約は、iOSアプリ「事故らんでや」（4区道路リスク。練馬・板橋・北・豊島の道路要注意度マップ。以下「本アプリ」）と、そのWeb版の利用条件を定めるものです。本アプリを使うことで、利用者は本規約に同意したものとします。
- 本アプリの道路の情報は目安です。道幅は国土地理院の5段階の区分で、実測値ではありません。通れるかどうかの最終判断は、必ず現地で行ってください。
- 運転中は画面を見続けたり操作したりしないでください。案内より、実際の道路・標識・交通規則を優先してください。
- Google の機能（APIキーを設定したとき）には、Google の規約も適用されます。APIキーの利用料金は、キーの持ち主に請求されます。

2. 使用の許諾
開発者は利用者に対し、利用者が所有または管理する Apple ブランドの製品で、App Store の利用規約に定める使用ルールに従って本アプリを使う、譲渡できない権利を許諾します。
3. 道路の情報について
- 道幅は国土地理院の5段階の区分で、実測値ではありません。勾配は標高のデータから求めた推定値です。要注意度はこれらから求めた目安です。
- 道路の状況は工事・規制・季節などで変わります。本アプリの情報の正確さ・新しさ・完全さは保証できません。通れるかどうかの最終判断は、必ず現地で行ってください。
- 道路のデータは、国土地理院ベクトルタイル（道路中心線）・標高タイル（DEM5A）を加工して作成し、一方通行・名称・区界には © OpenStreetMap contributors（ODbL）のデータを使っています。
4. ナビ（リアルタイムの経路案内）について
- 運転中は画面を見続けたり操作したりしないでください。操作は、安全な場所に止まってから行ってください。
- 案内より、実際の道路・標識・交通規則・警察官などの指示を優先してください。
- このリアルタイムの経路案内アプリケーションの使用は、利用者自身の責任で行ってください。位置情報は正確でない場合があります。
- YOUR USE OF THIS REAL TIME ROUTE GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE.
- 本アプリは、車両の自動運転・自動制御や、緊急・救命の目的には使えません。
5. Google のサービスについて
- 利用者が設定画面で Google Maps Platform の APIキーを入力すると、Google の地図・ストリートビュー・住所検索・ルート検索などを使います。これらの利用には、Google マップ / Google Earth 追加利用規約（https://maps.google.com/help/terms_maps/）と Google プライバシーポリシー（https://policies.google.com/privacy）が適用されます。
- Google のナビを初めて使うときは、Google の利用規約の画面が出ます。同意しないと Google のナビは使えません。
- APIキーは利用者自身の Google Cloud のものです。APIの利用料金はキーの持ち主に請求されます。無料枠を超えないよう、Google Cloud で1日の上限回数を設定してください（設定画面に手順があります）。開発者は、APIの利用料金について責任を負いません。
6. 保守とサポート
- 本アプリの保守とサポートは開発者が行います（第11項のお問い合わせ先）。Apple は本アプリの保守・サポートを行う義務を負いません。
- 本アプリは無料で提供しており、開発者は更新や機能の提供を続けることを約束しません。
7. 保証と責任
- 本アプリは現状のまま提供します。開発者は、本アプリが利用者の目的に合うこと、誤りや中断がないことを保証しません。
- 本アプリが適用される保証に適合しない場合、利用者は Apple に通知でき、Apple は本アプリの購入代金（本アプリは無料です）を返金できます。法令で認められる範囲で、Apple は本アプリについてほかの保証の義務を負いません。
- 本アプリの利用によって生じた損害について、開発者は、開発者の故意または重大な過失による場合を除き、責任を負いません。
8. 製品に関する申し立て・知的財産
- 本アプリに関する申し立て（製造物責任、法令や規制への不適合、消費者保護に関する申し立てなど）には、Apple ではなく開発者が対応します。
- 本アプリまたはその利用が第三者の知的財産権を侵害するという申し立てがあった場合、その調査・対応・解決は、Apple ではなく開発者が行います。
9. 法令の遵守と第三者の規約
- 利用者は、米国政府の禁輸の対象となっている国や「テロ支援国家」に指定された国にいないこと、米国政府の取引禁止・制限の対象者のリストに載っていないことを表明・保証します。
- 本アプリを使うときは、通信事業者や地図サービス（Apple・Google）など、第三者の規約にも従ってください。
10. 第三者受益者・規約の変更・準拠法
- Apple とその子会社は本規約の第三者受益者です。利用者が本規約に同意すると、Apple は第三者受益者として、利用者に対して本規約を執行する権利を持ちます。
- 本規約は、機能の追加や法令の変更などに応じて改定することがあります。改定した場合はこのページに掲載し、下記の日付を更新します。
- 本規約は日本法に準拠します。

Terms of Use (End User License Agreement)
These terms set out the conditions for using the iOS app "事故らんでや" (4区道路リスク, a road caution map for Nerima, Itabashi, Kita and Toshima wards in Tokyo; the "Application") and its web version. By using the Application, you agree to these terms.
- The road information in the Application is a guide only. Road widths are one of five classes from the Geospatial Information Authority of Japan (GSI), not measured values. Always decide on site whether you can pass.
- Do not keep looking at or operating the screen while driving. Follow the actual roads, signs and traffic rules rather than the guidance.
- Google's terms also apply to Google features (when an API key is set). API usage fees are charged to the owner of the key.
1. Parties and Relationship with Apple
- These terms are an agreement between you and the developer of the Application (the "Developer"). Apple Inc. is not a party to these terms. The Developer, not Apple, is solely responsible for the Application and its content.
- Matters not covered by these terms are governed by Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).
2. License
The Developer grants you a non-transferable license to use the Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.
3. Road Information
- Road widths are one of five classes from GSI, not measured values. Slopes are estimated from elevation data. Caution levels are a guide calculated from these.
- Road conditions change with construction, restrictions, seasons and so on. The accuracy, timeliness and completeness of the information are not guaranteed. Always decide on site whether you can pass.
- The road data is created by processing GSI Vector Tiles (road center lines) and elevation tiles (DEM5A); one-way information, names and ward boundaries use data © OpenStreetMap contributors (ODbL).
4. Navigation (Real-Time Route Guidance)
- Do not keep looking at or operating the screen while driving. Operate the Application only after stopping in a safe place.
- Follow the actual roads, signs, traffic rules and instructions of police officers rather than the guidance.
- YOUR USE OF THIS REAL TIME ROUTE GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE.
- The Application must not be used for automatic or autonomous control of vehicles, or for emergency or life-saving purposes.
5. Google Services
- When you enter a Google Maps Platform API key in the Settings screen, the Application uses Google's map, Street View, address search, route search and related services. Your use of them is subject to the Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps/) and the Google Privacy Policy (https://policies.google.com/privacy).
- The first time you use Google's navigation, Google's terms are shown. You cannot use Google's navigation without accepting them.
- The API key belongs to your own Google Cloud account, and API usage fees are charged to the owner of the key. Set daily limits in Google Cloud so that you stay within the free tier (the steps are in the Settings screen). The Developer is not responsible for API usage fees.
6. Maintenance and Support
- The Developer provides maintenance and support for the Application (see Section 11 for contact information). Apple has no obligation to furnish any maintenance and support services with respect to the Application.
- The Application is provided free of charge, and the Developer does not promise to continue providing updates or features.
7. Warranty and Liability
- The Application is provided "as is". The Developer does not warrant that the Application will meet your purposes or be free of errors or interruptions.
- In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the Application (the Application is free). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Application.
- The Developer is not liable for damages arising from the use of the Application, except in cases of intent or gross negligence on the part of the Developer.
8. Product Claims and Intellectual Property
- The Developer, not Apple, is responsible for addressing any claims relating to the Application, including product liability claims, claims that the Application fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the Application or your use of it infringes that third party's intellectual property rights, the Developer, not Apple, is solely responsible for the investigation, defense, settlement and discharge of the claim.
9. Legal Compliance and Third-Party Terms
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- When using the Application, you must also comply with applicable third-party terms, such as those of your wireless carrier and the map services (Apple and Google).
10. Third-Party Beneficiary, Changes and Governing Law
- Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
- These terms may be revised when features are added or laws change. Revisions are posted on this page and the date below is updated.
- These terms are governed by the laws of Japan.
